EXECUTIVE ORDER (NO. EO/BRF/018 OF 2009)

SUBJECT: SUBMISSION AND PROCESSING OF BUILDING PLAN APPLICATIONS
PREAMBLE:
It has come to my attention that some request for Building Permit Approvals have not progressed because the developments proposed in the areas are not compatible with the Building and Land Use Regulations in those areas. For example, hotels have been proposed in wholly residential areas.
Regrettably, it would seem that assessment of fees are made and collected before evaluation that reveals that an un-permitted Change of Use is intended, thereby stalling the progress of such applications.
This Order is therefore necessary in order to expedite the treatment of Development Permits.
NOW THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF LAGOS STATE, IT IS HEREBY:
ORDERED THAT:
a. That all proposed applications for Development Permit be first evaluated and validated for Land Use compliance before assessment of fees are made and payments collected; and
b. The Honourable Commissioner for Physical Planning and Urban Development and the Permanent Secretary are hereby directed to establish an information and Fast Track Unit for this purpose to assist and advise citizens on permissible developments and accelerate service delivery.
It is important for everyone serving in the Ministry of Physical Planning and Urban Development and other related Agencies to ensure that adequate public enlightenment is giving to all transacting business with them.
It is therefore mandatory that this Executive order is strictly adhered to.
Please give this order the widest publicity that it deserves.
This order is intended only to improve the internal management of the State Government and is not intended to, and does not create any rights or benefit, substantive or procedural, enforceable at law or in equity by a party against Lagos State, its departments, agencies or entities, its officers, employers, or agents, or any other person.
